What can you do if you are in financial trouble?

There are different ways to handle financial problems.  Find out which one is right for you.

If, for example:

~ your home is in danger of, or already in foreclosure,

~ a creditor has threatened to or has repossessed your car or truck,

~ you are being harassed by creditors,

~ you have lost income or have had a medical catastrophe,

~ or simply can not afford to pay debts and still have enough money to feed your family,

then some form of relief is most likely available to you.

Mandatory Credit Counseling

Within 180 days before you file a bankruptcy petition, you must receive an individual or group briefing from an approved counseling agency which explains the opportunities available and helps you perform a budget analysis.  

You are also required to complete a Debtor Financial Management Course after you file your case and before you receive your discharge.

The pre-bankruptcy counseling takes about an hour and you can do it via telephone or on-line, which is usually less expensive.  In some cases, you can ask for a waiver of the fee, which runs from between $5.00 and $50.00.

The Court maintains a list of those agencies approved in this District.  You can find that list by visiting the U.S. Department of Justice web site.

You will not be able to file your case without the pre-bankruptcy counseling certificate, and you will not get a discharge if you fail to file the financial management form after you file your case.
